TRUSTEE'S SALE
For default in the payment of debt and performance of obligations secured by that certain First Deed of Trust, Document No. 2022L5298, recorded November 15, 2022, in the Recorder's Office of the County of Polk, State of Missouri, executed by Brian Wayne Buttry, individually, Dana Michele Buttry, his wife, and Trinity Excavators, LLC, a Texas limited liability company, to Third Coast Bank, SSB, as Beneficiary, the undersigned Successor Trustee, will on October 2, 2024 at 1:00 PM, at the north door of the Polk County, Bolivar, Missouri Courthouse 102 E. Broadway Street Bolivar, Missouri 65613, sell at public vendue to the highest bidder for cash, subject to the terms announced at the sale, the real property legally described as:
Beginning at the Northeast corner of the Northeast One-Fourth of Northeast Quarter of
Section 8 Township 35 Range 21, thence South to the Southeast corner of said Northeast Quarter of Northeast Quarter thence Northwesterly to the Northwest corner of the Southeast Quarter of the Southeast Quarter of the Northeast Quarter of the Northeast Quarter of said Section 8 thence Northerly along the East line of the West half of the East half of the Northeast Quarter of the Northeast Quarter of said Section 8 to the Southeast corner of the Northwest Quarter of the Northeast Quarter of the Northeast Quarter of the Northeast Quarter of said Section 8 thence Northwesterly to the Northwest corner of said Northwest Quarter of the Northeast Quarter of the Northeast Quarter of the Northeast Quarter of said Section 8 thence Easterly along the North line of said Northeast Quarter of the Northeast Quarter of said Section 8 to the point of beginning (subject to a perpetual flowage easement granted to the United States of America over all that part thereof lying below elevation 879 (m.s.l.) and restrictive covenants thereto) Polk County, Missouri.
ALSO the Northwest One Fourth of the Northwest Quarter of Section 9 and the West Half of the Northeast One Fourth of the Northwest Quarter of Section 9 all in Township 35 Range 21 all being situate in Polk County, Missouri. Subject to encumbrances of record.
ALSO a permanent, assignable, Non-exclusive Road Easement over the South 30 feet of
the East Half of the Northeast Quarter of the Northwest Quarter of Section 9, Township 35,
Range 21, All in Polk County, Missouri (Subject to Public Roads). Subject to restriction, reservation, easements and covenants of record if any.
To satisfy said debt, performance of obligations, and costs to the extent of the purchase
price paid by the successful bidder at said sale.
WHEREAS, by an Appointment of Successor Trustee, dated August 19, 2024, and recorded August 23, 2024, under Document No. 2024L3118, in the Office of the Recorder of Deeds of the County of Polk, State of Missouri, KRST Corporation, a Missouri corporation, was appointed and named Successor Trustee.
Notice of said sale is also being published in Bolivar Herald-Free Press newspaper as provided by RSMo 443.320, with the first publication starting on September 4, 2024. KRST Corporation, a Missouri corporation.
